1. Acceptance of Terms
By downloading, installing, or using the Caddy Booking mobile application ('Platform'), you agree to these Terms and Conditions ('Terms'). If you do not agree, do not use our Platform. These Terms are legally binding.
2. Definitions
• Platform: The Caddy Booking mobile application • Booking: A confirmed reservation for caddy services • Services: Caddy services offered through our Platform • Caddy: An independent contractor who offers golf assistance services • Tee Time: The scheduled time at which the Golfer begins to play • User: Anyone who uses our Platform
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under applicable law.
4. Account Registration & Security
You are responsible for providing accurate information during registration and maintaining account security. You are responsible for all activities under your account.
5. Booking Process
Select date, time, golf course, and desired caddy services. 1. A booking is complete only when the Platform displays a 'Confirmed' status. 2. Payment of any applicable fees must be completed according to the Platform's instructions.
6. Cancellation Policy
1. You may cancel a Booking at least 12 hours before the scheduled Tee Time for a full refund. 2. Cancellations within 12 hours may result in forfeiture of fees paid. 3. If you cancel your Booking within a single calendar day, your account will be temporarily suspended for three (3) business days. 4. If you cancel your Booking within twelve (12) hours more than three (3) times, your account will be permanently suspended.
7. Payments & Fees
All fees are displayed before booking completion. 1. You authorize Caddy Booking to charge your selected payment method for all applicable fees incurred during Platform use. 2. Payment Method: You authorize Caddy Booking to store your payment information for authorized transactions. 3. Refunds: Refunds, if any, follow the Cancellation policy above. 4. Disputes: For payment disputes, contact our customer service within thirty (30) days of the transaction date.
8. User Obligations
1. Arrive at the golf course at least 15 minutes before your Tee Time. 2. Maintain appropriate golf attire, etiquette, and respect. 3. Provide accurate information when using or registered on the Platform.
9. Prohibited Conduct
You agree not to: a. Use the Platform for fraudulent purposes b. Circumvent fees or manipulate the rating system c. Reverse engineer or interfere with the Platform's functionality d. Post defamatory, offensive, or unlawful content
10. Ratings & Reviews
Golfer feedback must be honest, factual, and based on actual experiences. We reserve the right to remove reviews that violate these Terms.
11. Suspension & Termination
We may suspend or terminate your account for: a. Violations of Section 6 (e.g., cancellation policy violations) b. Providing false or inaccurate information c. Suspected illegal activities or fraudulent use d. Suspended users cannot create new Bookings until restrictions are lifted or until the restriction period ends.
12. Intellectual Property
All logos, trademarks, and content on the Platform are our property or our licensors' property. You may not use them without explicit written permission.
13. Privacy
Your personal data is processed in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to such processing.
14. Disclaimers
Caddy Booking provides the Platform on an 'as-is' basis. We do not guarantee uninterrupted access. We disclaim all warranties, express or implied, to the fullest extent permitted by law.
15. Indemnification
You agree to indemnify and hold Caddy Booking, its officers, directors, employees, and agents harmless from any claims, damages, or expenses arising from your use of the Platform, even if advised of the possibility of such damages. This indemnification shall not apply to the three (3) months preceding the claim, or the date published in the 14.0.0.
16. Modifications to Terms
We may update these Terms periodically. Changes will be notified via app or via email. Continued use of the Platform after notification constitutes acceptance of the modified Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Bangkok, Thailand.
